Terms of Service
These Terms of Service govern your use of the ULYV website, online store, products, and related services. In these Terms, “ULYV,” “we,” “us,” and “our” refer to ULYV. By visiting our website, creating an account, or purchasing from us, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Return and Refund Policy.
1. Eligibility and Acceptable Use
You must be at least the age of majority in your province, territory, state, or country of residence, or have permission from a parent or legal guardian, to use the store or place an order. You may not use our website, products, or services for any unlawful, fraudulent, abusive, or unauthorized purpose; interfere with the security or operation of the website; transmit malicious code; scrape or copy the website without permission; or violate another person’s rights.
2. Products and Information
We make reasonable efforts to display product descriptions, colours, sizes, images, and other information accurately. Colours and appearance may vary depending on lighting, photography, and device displays. We may correct errors, update information, change or discontinue products, and limit quantities at any time. Product availability is not guaranteed.
3. Prices, Payments, and Taxes
Unless otherwise stated, prices are shown in Canadian dollars. Applicable taxes and any other charges will be displayed at checkout. You agree to provide current, complete, and accurate billing and payment information and confirm that you are authorized to use the payment method submitted. Payment must be approved before an order is fulfilled.
4. Orders
Your order is an offer to purchase. We may accept, reject, limit, or cancel an order, including because of inventory issues, pricing or description errors, suspected fraud, payment problems, resale activity, or shipping restrictions. If we cancel an order after payment has been collected, we will refund the amount charged for the cancelled portion.
5. Shipping, Returns, Exchanges, and Refunds
Shipping is governed by our Shipping Policy. Returns, exchanges, and refunds are governed by our Return and Refund Policy. Those policies form part of these Terms. Delivery dates are estimates and may be affected by circumstances outside our reasonable control.
6. Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity under your account. Notify us promptly if you believe your account has been accessed without authorization. We may suspend or terminate accounts that violate these Terms or create a security, legal, or operational risk.
7. Intellectual Property
The ULYV name, branding, logos, product designs, photographs, graphics, text, website layout, and other content are owned by or licensed to ULYV and are protected by applicable intellectual-property laws. You may use the website only for personal, non-commercial shopping purposes. No content may be reproduced, distributed, modified, sold, or exploited without prior written permission.
8. Reviews and Customer Content
If you submit a review, photo, comment, suggestion, or other content, you confirm that you have the right to provide it and that it is truthful, lawful, and does not violate another person’s rights. You grant ULYV a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, and display that content for operating and promoting the business. We may remove content that is unlawful, misleading, offensive, or otherwise inappropriate.
9. Third-Party Services and Links
Our store is hosted by Shopify and may use third-party payment, shipping, analytics, social-media, or other services. Third-party websites and services are governed by their own terms and privacy practices. To the extent permitted by law, ULYV is not responsible for third-party content, acts, omissions, availability, or services.
10. Privacy
Our collection, use, and disclosure of personal information are described in our Privacy Policy. By using the store, you acknowledge that information may be processed by Shopify and other service providers as required to operate the store, process payments, fulfil orders, and provide customer support.
11. Disclaimers
To the fullest extent permitted by law, the website and services are provided on an “as is” and “as available” basis. We do not guarantee that access will be uninterrupted, secure, or error-free. Nothing in these Terms excludes or limits any warranty, condition, right, or remedy that cannot legally be excluded under applicable consumer-protection law.
12. Limitation of Liability
To the fullest extent permitted by law, ULYV and its owners, personnel, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential loss arising from your use of the website, services, or products. Where liability cannot be excluded, our total liability will be limited to the amount you paid for the product or order giving rise to the claim, except where applicable law requires otherwise.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold ULYV harmless from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the services, your breach of these Terms, or your violation of another person’s rights.
14. Events Outside Our Control
We are not responsible for a delay or failure caused by events outside our reasonable control, including carrier disruptions, severe weather, natural disasters, labour disputes, governmental action, internet or utility outages, or supply-chain interruptions.
15. Severability and Waiver
If any part of these Terms is found unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of that provision or any other right.
16. Governing Law
These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada. The courts of Alberta will have jurisdiction over disputes, except where mandatory consumer-protection or other applicable law provides otherwise.
17. Changes to These Terms
We may update these Terms by posting a revised version on the website. Changes apply from the stated “Last updated” date. Your continued use of the services after the updated Terms are posted constitutes acceptance to the extent permitted by law.
